Fifth Circuit Issues Two Life-Saving Decisions in One Week

Your prayers and support continue to produce results. Thanks to some wise and perceptive jurists on the U.S. Court of Appeals for the 5th Circuit, it’s been a very good month for you and for all of us who believe in the sanctity of life, and who are working together to secure stronger protections for every life, from the womb to the grave.
On August 17, the 5th Circuit ruled against the owners of several abortion clinics, who had appealed the dismissal of their lawsuit against a Louisiana law requiring them to meet certain patient health and safety regulations. Can you imagine: suing for the right to offer more hazardous abortions? That alone reveals a great deal of the mindset of those pressing for expansion of abortion in America, many of whom care as little for the mothers who visit these clinics as they do for the children in their wombs.
“A woman’s health and safety should always be the most important concern in cases like this, and that is indeed the highest concern of Louisiana health officials,” says Alliance Defending Freedom Senior Counsel Steven H. Aden, who served as co-counsel for the state health department in arguing to uphold the original district court decision that threw out the lawsuit. “The district court was right to reject this challenge to basic health and safety regulations, and the 5th Circuit has done the right thing in upholding that decision.”
Although we were not as directly involved, our attorneys were just as pleased with another 5th Circuit decision on August 21 that allows the state of Texas to discontinue funding for Planned Parenthood as part of the Texas Women’s Health Program. The decision has good implications for two cases Alliance Defending Freedom is litigating, in which our attorneys are representing two former Planned Parenthood clinic directors who allege that Planned Parenthood has been engaging in millions of dollars of Medicaid fraud.
“Taxpayers should not be forced to pay for abortions or abortion advocacy,” says Aden. “The court’s August 21 decision against the position of Planned Parenthood and the Obama administration again demonstrates that abortionists and their political allies are bluffing when they say that states cannot stop taxpayer funding from being used to subsidize abortions, whether directly or indirectly.
“The court has done the right thing in upholding the right of Texas to exclude this kind of funding from the program,” he adds, “especially for organizations like Planned Parenthood, which is currently under investigation by Congress for fraud.”
Any time we are able to expose the hypocrisies and dangers of Planned Parenthood and its ilk, we move that much closer to providing a legal environment that protects life and provides greater safety and protection for your children and grandchildren.
